Many different types of accidents fall under the umbrella of personal injury litigation. If you were involved in a car, truck, motorcycle, bike, train, boat or pedestrian accident, you should answer yes to this question. You should also answer yes if you were involved in a slip & fall accident, an accident caused by a defective product, or an accident at work.
If you were a patient who suffered injury while under the care of a hospital, doctor, nurse, nursing home, aide, dentist or other healthcare provider, answer yes to this question. You may also have a legal malpractice case if you believe that an attorney improperly handled your case.
Question 2: Were you seriously injured in the accident or incident of malpractice?
You have determined whether or not you were involved in an accident or incident of malpractice. Now it is important to realize whether or not you were injured in this accident.
The degree of injury will play a role in deciding whether or not to answer yes to this question. If you sustained serious injuries that required hospitalization or continuing medical treatment or left you with ongoing disabilities, you should answer yes to this question. If your injuries were minor without long–lasting effects, you may not have a claim.
Question 3: Was the accident or incident of malpractice the result of someone else's negligence?
Did someone else play a role in your injury? Was this person acting negligently, whether it was behind the wheel or in the operating room? Webster's Dictionary defines negligence as the "failure to exercise the care that a reasonable person would exercise in like circumstances."
If you believe that your accident and injury resulted from someone else's carelessness, you should answer yes.
Question 4: Did the accident or incident of malpractice happen in the state of California?
